    To není přiléhavá reflexe tématu.

    Pravidelná péče o kůži (včetně kosmetiky) má samozřejmě význam a možná i nezanedbatelné výsledky. Ale nemá to opravdu nic společného s reklamními báchorkami o zpomalování stárnutí kožních buněk.

    "Viditelné" výsledky na 0,1 mm tenké epidermis jsou navíc velkou hypotézou. Viditelné výsledky se dosahují pravidelně účinky až na tkáně pod pokožkou. (hlubší vrstvy). Tam mohou účinkovat léčivé přípravky. Tyto struktury nejsou určeny k "legálním" účinkům kosmetiky. Ale to je pro laickou veřejnost jen obtížně představitelná a pochopitelná konstrukce práva EU. Své odůvodnění to ale má. Dovolím si tady něco neobvyklého. Přepisuji stanovisko KOMISE EU na náš odborný dotaz. Je to v AJ - pro vážné zájemce:

    The responsible Unit of the Directorate-General -DG- for Health and Consumers provided the following answer to your question:

    "As a preliminary comment, please note that the Commission cannot definitively decide on the classification of individual products as cosmetics or other. It is the obligation of national competent authorities to determine for any individual product, on a case-by-case basis, whether it falls within the scope of application of the Cosmetics Regulation* or within the scope of application of other sectorial legislation. The European Court of Justice has repeatedly held that the national authorities, acting under the supervision of the courts, must proceed on a case-by case basis, taking account of all the characteristics of the product.

    That said, according to the Cosmetics Regulation, Art. 2(1)(a), ‘cosmetic product’ means any substance or mixture intended to be placed in contact with the external parts of the human body (epidermis, hair system, nails, lips and external genital organs) or with the teeth and the mucous membranes of the oral cavity with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition or correcting body odours.

    Products that are exclusively or mainly there to influence the status or functions of tissues and anatomical structures of the human body located deeper under the skin (under the stratum basale of epidermis), such as adipose tissue, connective tissue, blood vessels, nerves or male erectile bodies of the penis cannot be classified as cosmetics, as they are very likely to significantly restore, correct or modify physiological functions by exerting a pharmacological, immunological or metabolic action. In addition, nothing is said about the purpose the product is meant to fulfil in your email.

    Nevertheless, we suggest that you check with the national authorities of the country where you wish to place the product on the market to clarify the classification of your product.
